Welcome to dpack.com.au ("Site"), operated by DPack (ABN 74 855 440 553). By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site.

1. Definitions

  • "You," "your" refers to the person or business accessing our Site or placing an order
  • "Site" refers to dpack.com.au and all associated services
  • "Products" refers to all goods available for purchase on our Site
  • "Order" refers to a request to purchase Products through our Site

  • If ordering on behalf of a business, authorised to bind that business to these Terms

  • All prices are in Australian Dollars (AUD)
  • All prices displayed on product pages are exclusive of GST (ex GST)
  • GST (10%) is calculated and added at checkout
  • Prices are subject to change without prior notice
  • The price at the time of checkout applies to your order

Pricing Errors

We make every effort to ensure pricing accuracy. If we discover a pricing error after your order is placed, we will:

  • Contact you before processing the order
  • Offer you the option to proceed at the correct price or cancel your order
  • Provide a full refund if you choose to cancel

5. Orders and Acceptance

  • Placing an order on our Site constitutes an offer to purchase
  • An order confirmation email is an acknowledgement of receipt, not acceptance of your order
  • Your order is accepted when we dispatch the Products and provide tracking information
  • We reserve the right to accept, decline, or cancel any order at our discretion, including but not limited to cases of pricing errors, stock unavailability, suspected fraud, or violation of these Terms
  • If we cancel your order, you will receive a full refund

  • We strive to provide accurate product descriptions, images, and specifications
  • Product images are representative; actual products may vary slightly in colour, size, or packaging due to manufacturer variations, screen settings, or updated packaging
  • Pack sizes, carton quantities, and dimensions are listed on product pages
  • We recommend checking product specifications before ordering, particularly for food-contact and hygiene products

7. Stock Availability

  • Stock levels displayed on our Site are updated regularly but are not guaranteed in real-time
  • If an item is out of stock after you have placed an order, we will contact you within 1 business day to offer alternatives or a refund
  • For large wholesale orders, we recommend contacting us to confirm stock availability before ordering

8. Payment

  • We accept Visa, Mastercard, American Express, and other payment methods as displayed at checkout
  • Payment is required at the time of ordering
  • All transactions are processed securely through PCI-DSS compliant payment providers
  • If payment fails, your order will not be processed

9. Shipping and Delivery

Delivery timeframes are estimates and not guaranteed. Risk of loss transfers to you upon delivery.

10. Returns and Refunds

Please refer to our Return & Refund Policy for full details. Key points include:

  • 30-day change of mind returns for unopened products in original condition
  • A 20% restocking fee applies to change of mind returns
  • Customer is responsible for return shipping costs on change of mind returns
  • Full refund or replacement for faulty, defective, or incorrectly shipped products (no restocking fee)
  • Your rights under the Australian Consumer Law are protected and cannot be excluded

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be lawfully excluded or modified.

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

12. Product Use and Safety

  • Products must be used for their intended purpose as described on the product page
  • Follow all safety instructions, warnings, and usage guidelines provided with the product or on our website
  • For food-contact products (cups, containers, cutlery), customers are responsible for ensuring compliance with relevant food safety standards and regulations for their specific use
  • We are not liable for damage or injury caused by misuse of products

  • All content on this Site, including logos, images, text, graphics, and design, is the property of DPack or its licensors and is protected by Australian and international copyright law
  • You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent

  • Use our Site for any unlawful purpose
  • Violate any applicable Australian or international laws or regulations
  • Transmit viruses, malware, or any other harmful code
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to collect data from our Site without permission
  • Interfere with or disrupt the operation of our Site
  • Misrepresent your identity or affiliation with any person or entity

15. Limitation of Liability

To the maximum extent permitted by Australian law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or Products
  • Our total liability for any claim arising from or related to your use of our Site or the purchase of Products is limited to the amount you paid for the relevant Products

Our Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party websites. Accessing third-party links is at your own risk.

18. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supplier failures, industrial disputes, or transportation disruptions.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Site after changes are posted constitutes your acceptance of the modified Terms.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

21. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or your use of our Site will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

For disputes under $10,000, we encourage resolution through the Victorian Civil and Administrative Tribunal (VCAT) or the Australian Disputes Centre.

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and DPack regarding your use of our Site and purchase of Products.
